COVID-19 - We are open for business and here to help

Individuals of high net worth who intend on making a substantial investment in the UK can apply for a Tier 1 Investor Visa, which enables them, their spouse and their children to reside in the UK. Due to the complex nature of the UK’s immigration system and visa application process, not to mention other important considerations such as tax planning, it is of the utmost importance that applicants consult with an experienced Immigration Lawyer at the earliest possible stage.

Wilford Smith has for many years advised high net worth clients on a wide range of legal issues and has a well-earned reputation for excellence when it comes to dealing with UK Visas & Immigration. Speak with one of our solicitors today to find out how we can support your application for a Tier 1 Investor Visa.

What is a Tier 1 Investor Visa?

A Tier 1 Investor Visa is open to wealthy individuals who have sufficient funds available to put into specific investments in the UK, for example in UK government bonds and loan or share capital in active and trading UK-registered companies. Unlike other Tier 1 visas, it is not a requirement that applicants have a job or company in the UK, or a business or institution acting as a sponsor. Instead, an applicant’s credibility is determined by their ability to invest in the UK, alongside meeting specific criteria assessed using a UKVI points-based system. Those applying for a Tier 1 Investor Visa do not have to satisfy English language requirements or show that they have a particular level of funds available to support themselves during their time living in the UK.

How do I demonstrate that I qualify for a Tier 1 Investor Visa?

The first, and most obvious, requirement is that you can show that you have available to you the minimum investment sum. These funds must be held in one or more regulated financial institutions, and you must be able to prove that this money belongs to you, or to your spouse or partner. Your funds must be disposable in the UK – this means that they must be kept in such a way that they are accessible for investment as and when needed. You must also be able to show that you have an appropriate investment account with a UK-based bank when making your application. If issued with a Tier 1 Investor Visa, you will be required to invest your funds within three months of your entry into the UK.

What benefits are afforded to those who hold a Tier 1 Investor Visa?

Once you have been granted a Tier 1 Investor Visa, your qualifying family members will be able to join you in the UK as your dependents. Your visa will initially be issued for three years, but there exists the scope for this to be extended for a further two years following a successful application. Should you wish to do so, you will be able to work, study or engage in business activity within the UK without the need for further immigration permission, with these benefits also being open to your dependent family members. Depending on your level of investment in the UK, you may be able to apply to settle permanently after having lived here for a qualifying period.
