The case of a student who was wrongly put on trial for rape as a result of police withholding vital evidence is “just the tip of the iceberg”, Mr Singh told The Times. Following the collapse of the case against Liam Allan, a 22-year-old student who spent almost two years on bail after being falsely accused of rape, Mr Singh said:
“Disclosure is the backbone of the criminal justice system, and a defence team must be able to trust the prosecution to properly discharge their disclosure duties.”
A report by HM Crown Prosecution Service Inspectorate, disclosed to The Times, has shown that in the past three years alone dozens of cases have collapsed as a consequence of the way that police have handled evidence. Inspectors found that at least 56 cases have been aborted since 2013 due to the police’s failure to disclose evidence, with more than half of the 146 cases reviewed showing “obvious disclosure issues” in the stages prior to a suspect being charged.
